Terms of Service

1. Introduction

These Terms of Service govern your use of the Scott Bargains AI service operated by SCOTT BARGAINS LTD. By creating an account, you agree to these terms. If you do not agree, please do not use the Service.

2. Your account

• You must be at least 18 years old and legally able to enter a contract.
• You are responsible for the accuracy of the information in your account and for keeping your login credentials secure.
• You may not share your account with other businesses or people outside your stated organisation.

3. The Service

Scott Bargains AI provides AI-assisted drafting tools for restaurant marketing content. Outputs are drafts — you are responsible for reviewing, editing and confirming the accuracy of any content you publish or send.

4. Subscriptions and credits

• Subscriptions renew automatically until you cancel.
• Credits reset on each monthly or annual renewal based on your plan. Unused plan credits do not carry over beyond a renewal period.
• Top-up credit packs are one-off purchases. Top-up credits remain in your account while your subscription is active.
• Free promotional credits (e.g. the 50 sign-up bonus) expire 14 days after issue and are non-transferable.
• All prices are stated in USD. Regional taxes (VAT, GST, US sales tax) are calculated at checkout based on your billing address.

5. Cancellation

You can cancel from the Stripe billing portal at any time. Your subscription remains active until the end of the paid period, and you retain access to your content for 30 days after cancellation before export is required.

7. Acceptable use

You agree not to use the Service to generate, distribute, or facilitate:

• Hateful, harassing, or discriminatory content.
• Fraudulent reviews, fake testimonials, or content misrepresenting another business.
• Misleading health, weight-loss or medicinal claims about food or drink.
• Invented allergen information or fabricated nutritional values presented as verified.
• Explicit sexual content, content sexualising minors, or content glamourising violence.
• Any content that infringes intellectual-property rights or privacy rights of a third party.

We reserve the right to suspend or terminate accounts that breach these rules.

8. Intellectual property

• Your content: you keep all rights to the brand material you upload and to any output generated for your brand. You grant Scott Bargains a limited, internal licence to process that content to deliver the Service.
• Our content: the Service itself, our templates, brand, design, software, and documentation remain our property or the property of our licensors.

9. Limitation of liability

To the fullest extent permitted by law, Scott Bargains is not liable for:

• Errors in allergen, nutritional, pricing or product claims you choose to publish.
• Third-party platform outages (social channels, delivery marketplaces, Stripe).
• Indirect, incidental or consequential loss.

Our total aggregate liability for any claim is limited to the fees you have paid in the 12 months preceding the claim.

10. Changes to the Service

We continuously improve the Service. We may add, change, or retire features with reasonable notice. Material downgrades to a paid plan will entitle you to a pro-rata refund.

11. Governing law

These terms are governed by Scots law. Any dispute will be resolved in the courts of Scotland.
